Court rejects 2 Phulambri councillors plea

Aurangabad, May 8:

Justice A J Jamadar from the Aurangabad bench of Bombay High Court rejected two disqualified elected members of Phulambri Municipal Council.

According to details, council member Indubai Madhukar Misal’s son Yogesh and another member Dwarkabi Jadhav’s husband Santosh Jadhav started illegal construction on a piece of land (gut no 353) belonging to Maharashtra State Board of Wakfs (MSBW). The Board of officers conducted a panchanama of the spot.

Syed Zulfeqar complained that Dwarkabai and Indubai should be disqualified for carrying out illegal construction.

Tehsildar served a notice to husband of Dwarkabai and son of Indubai.

Also, Wakfs Tribunal issued orders to stop the construction.

The district collector disqualified both the council members.

The disqualified councillors appealed with Urban Development Ministry, which also rejected their plea.

Both the petitioners challenged the decision in the HC.

The petitioners stated in their plea that the construction could not be term illegal as panchanama has no details about four sides of the land.

The petitioners requested the court to cancel the orders of their disqualification. Adv Ravindra Gore argued for the main petitioner.

Government pleaders termed the orders of district collector and Urban Development Minister as legal.

The HC observed that the evidence indicates that husband and son of councillors and others are involved in the illegal construction and rejected the petition. Adv Chandrakatn Bodkhe assisted adv Gore.
