HC grants stay on recovery of benefits from promoted employees

Aurangabad, March 31:

Aurangabad bench of Bombay High Court comprising Justice S V Gangapurwala and Justice Shrikant D Kulkarni granted a stay until further orders on the recovery of promotion benefits availed by the non-teaching employees of Nanded Zilla Parishad under Modified Assured Career Progression (MACP) Scheme.

The next hearing has been placed on June 24. The court has issued directives to serve notice to respondents.

The State Government implemented a time-bound promotion scheme, assured career progression scheme, and Modified Assured Career Progression Scheme (MACPS) as per the Fourth, Fifth and Sixth Pay Commission's recommendations.

The employees of Nanded ZP were given the benefit of 12 years time-bound promotion. The employees were eligible for the programme after January 1, 2016.

The State Government implemented the MACP scheme with Seventh Pay Commission taking into consideration earlier schemes.

The orders of eligibility of employees after January 1,2016, was cancelled and revised orders were issued to provide the benefits of 10, 20 and 30 years of service promotion to the employees.

The pay fixation was done without taking into consideration the norms. The assistant director of the Local Fund Accounts Department took objection to the pay fixation. So, the chief accounts and finance officer of ZP took the decision of recovery from the employees.

Madhav Pand and others filed a petition through adv Shivkumar Mathpati against the decision of the chief accounts and finance officer.
