Bombay HC: Cannot allow lawyers to travel by Mumbai local train amid fear of third COVID-19 wave

The Bombay High Court on Saturday said it cannot allow lawyers to travel by Mumbai local trains at least till the end of July as the Maharashtra State COVID-19 Task Force amid fear of third covid wave.

A division bench of Chief Justice Dipankar Datta and Justice G S Kulkarni said that the court cannot override medical experts opinion by a judicial order. “At least till the end of July, it may not be possible (to allow lawyers to commute by trains). 

Maharashtra COVID Task Force has warned of third wave if the government allows general public to travel by train. You (lawyers) will have to wait for one more month,” the court said. 

A PIL was filed by the Bar Council of Maharashtra and Goa regarding the exclusion of lawyers from Mumbai local train travel. At present, only state government and public administration officials are allowed to travel by local train. 

The court posted the matter for further hearing on August 3.
