Court dismisses petition seeking cancellation of tender process

Aurangabad, July 17:

Justice S V Gangapurwala and Justice R N Ladda of the Aurangabad Bench of Bombay High Court on Friday dismissed a petition seeking cancellation of a combined tender process for various development works in Paithan city.

Government approved contractor Suraj Jadhav, had filed the petition regarding the cancellation of a combined tender for 56 development works. According to the petitioner, the Public Works Department (PWD) cannot issue a combined tender for various works. As a combined tender was floated, he could not participate in the tender process as the cost tender was more than Rs 12 crore and exceeded the capacity of the petitioner. Also, only one organisation was able to participate in the entire tender process. Therefore, the tender process should be canceled. During the hearing, the government and the PWD refuted all the points in the petition. Assistant public prosecutor Atul Kale representing government and PWD pointed out that the petitioner's notion against a joint tender was wrong on the basis of various rulings. He also pointed out that the rules were followed in a transparent manner during the tender process. All the points raised by the petitioners were refuted on the basis of the decisions of the Supreme Court. Senior lawyer V D Hon and S R Nikam represented the petitioner.
