SC rejects petition about flyover tender

Aurangabad, Dec 21:

The Aurangabad division bench of Bombay High Court had earlier rejected the petition requesting to cancel the tender about the road expansion between Cambridge School to Mahanubhav Ashram (Beed By-pass) and flyovers at four places. Now, the Supreme Court has rejected the petition challenging the decision of the bench.

The SC bench comprising Justice Rohington Nariman and Justice Naveen Sinha rejected the plea after observing that there is no concrete point to interfere in the decision of the division bench. The Public Works Department (PWD) had invited tenders under the World Bank project. The lowest bid of GNI Infrastructure and Manjeet Cotton Pvt Ltd was accepted. Meanwhile, petitioner Ajaydeep Construction Pvt Ltd, a bidder submitted a petition at the Aurangabad division bench stating that the contracted tender holders does not fulfill the terms and condition of the tender and requested to cancel the tender process and implemented the new tender process.

Division bench comprising Justice S V Gangapurwala and Justice R G Avchat rejected the petition on September 24, 2020. Ajaydeep Construction challenged the decision at the Supreme Court and the hearing was held on December 16, 2020.

Senior counsel, Dr Abhishek Manu Singhvi, senior counsel K V Vishwanathan and Adv Mahesh Agrawal appeared for Ajaydeep Constructions while senior counsel D S Kamat, Adv Devdutta Palodkar and Adv Shashibhushan Adgaonkar for GNI-Manjeet.
