State government served notice over custodial death

Aurangabad division bench of Bombay High Court comprising Justice T V Nalawade and Justice M G Sevalikar ordered to issue notices to state government, Jalgaon superintendent of police and Bhusawal police over the death of Sunil Taru in the magisterial custody.

Sunil Taru’s wife submitted a petition in the division bench. Taru lived with his family at Changdev at Muktainagar tehsil. His uncle lodged a complaint at Muktainagar court against Sunil and his mother over a quarrel. Initially, Sunil and his mother were present in the court. However, they remained absent for the next hearings. Hence, a non-bailable warrant was issued against Sunil. The police arrested and was produced before the court. However, he was sent to the magisterial custody as there was no guarantor. He was to be produced before the court on March 5, 2020. However, he was admitted to the Jalgaon district hospital ICU as his condition deteriorated, the police informed Sunil’s wife on phone. On the same day, Sunil died at the hospital. In the post mortem report, it was mentioned that he died due to head injury. Hence, Sunil’s wife Mangala went to superintendent of police but no action was taken. Hence, she submitted a petition at the division bench. She demanded for inquiry in the matter and compensation of Rs 25 lakh from the government in the petition.
